1. Age & Legal Compliance
You must be 21 years or older to use our Sites or purchase cannabis products. By using our Services, you confirm compliance with all applicable NJ cannabis laws under the CREAMM Act (N.J.S.A. 24:6I-31 et seq.) and NJ-CRC regulations. Valid government-issued photo ID is required at point of sale and for online orders. Staff will verify your ID but will not retain copies beyond what is required to complete the transaction, per NJ-CRC regulations.
2. User Representations
By using our Service, you represent and warrant that:
- You are 21 years of age or older and legally permitted to purchase cannabis in the state in which you are located
- All information you provide to Fire & Oak is true, accurate, and complete
- You will use the Service only for lawful purposes and in compliance with all applicable federal, state, and local laws
- You will not use the Service on behalf of any person who does not meet the above requirements
- You understand that cannabis remains a Schedule I controlled substance under federal law
Fire & Oak reserves the right to terminate access for any user who misrepresents their eligibility or provides false information.
3. Purchase Limits — NJ-CRC Requirements
Per N.J.A.C. 17:30, adult-use customers (21+) are subject to the following per-transaction limits:
- Flower / pre-rolls: up to 1 oz (28.35 g)
- Solid concentrates / resin: up to 4 grams
- Liquid concentrates / vape oils: equivalent of 4 grams
- Edibles: up to 1,000 mg THC
- Mixed purchases: combined total may not exceed 1 oz equivalency
- Medical patients: up to 3 oz per rolling 30-day period
Tracking your purchase history is your responsibility. Fire & Oak reserves the right to decline any sale that would cause a customer to exceed the legal purchase limit.
4. Prohibited Conduct
You agree that you will not, directly or indirectly:
- Use automated bots, scrapers, crawlers, or similar tools to access, copy, or harvest any content from our website or e-commerce platform
- Attempt to bypass, circumvent, or defeat any age-gating mechanism, identity verification, or access control on our Sites
- Use or attempt to use fraudulent, altered, or borrowed identification documents
- Fraudulently obtain discounts by misrepresenting eligibility (veteran, student, senior, medical patient, or industry professional status)
- Interfere with or disrupt the operation of our website, servers, or networks
- Use our Sites to transmit spam, malware, or any unauthorized commercial communications
- Impersonate Fire & Oak, its employees, or any other person or entity
- Use the Service for any purpose that violates applicable federal, state, or local law
Violation of these prohibitions may result in immediate termination of access, forfeiture of loyalty points, and may subject you to legal liability.
5. Orders, Pickup, Delivery & Payment
Submitting an order constitutes an offer to purchase. Fire & Oak must confirm acceptance before the order is binding.
Pickup & Delivery Options

- Curbside pickup: available with advance online order
- Delivery: available in select service areas. Age verification (21+) required at the door. Delivery personnel will not retain copies of ID per NJ-CRC regulations.
Online orders can be placed at any time and will be fulfilled during operating hours (Mon–Sat 9am–9pm, Sun 10am–8pm).
Accepted Payment Methods
Online (Sweed platform): ACH bank transfer only, processed by Aeropay (Aero Payments, Inc.). By completing an online payment you also agree to Aeropay's Terms of Service. Fire & Oak is not responsible for payment failures, bank verification issues, or ACH disputes.
In-store: Cash (ATM on-site) and PIN debit. Credit cards are not accepted at any point due to federal banking restrictions on cannabis transactions.
All transactions are subject to NJ state sales tax of 6.625% and a 2% local cannabis transfer tax.
6. Return Policy — All Sales Final
All cannabis sales are final under NJ state law and NJ-CRC regulations. Fire & Oak does not accept returns or exchanges once a transaction is completed.
Quality defects or packaging issues must be reported within 24 hours at info@faomtholly.com or (609) 901-0698 with description and photos. Any resolution is at the sole discretion of Fire & Oak management.
Cancellations are available before processing begins. ACH refunds are subject to Aeropay's processing timeline.
7. Loyalty Program
Fire & Oak rewards customers for qualifying purchases in-store and online. Full program disclosures including data collection practices are described in our Privacy Policy, Section 7.
Loyalty Tiers (Lifetime Points)
- Trailblazer (0–999 pts) — 1 pt per $1
- Craft Explorer (1,000–2,999 pts) — 1.1 pts per $1
- Connoisseur (3,000–4,999 pts) — 1.2 pts per $1
- FAO Elite (5,000+ pts) — 1.5 pts per $1
Redeeming Points
200 pts = $5 OFF • 400 pts = $10 OFF • 800 pts = $20 OFF • 1,000 pts = $25 OFF
Inactivity & Program Terms
Points and tier status reset after 48 months of inactivity. Points have no cash value, are non-transferable, and are forfeited on account closure. Fire & Oak may modify or terminate the program with reasonable notice.
8. Promotions & Discounts
- Shop Mt. Holly: 10% off with same-day $20+ receipt from any Mt. Holly business
- Daily special discounts: Veterans & First Responders, Students & Seniors, Medical Patients, Industry Professionals (valid ID or proof required)
Discounts cannot be combined unless stated. All offers are subject to change. Fraudulent use of discounts may result in refusal of service.
9. Advertising Compliance — N.J.A.C. 17:30-11.8
All Fire & Oak marketing complies with NJ-CRC regulations: directed to 71.6%+ adult audiences; no cartoons or minor-directed content; no health claims; no claims of FDA approval or non-addictiveness.
10. Intellectual Property
All content on our Sites is owned by Fire & Oak and may not be copied or repurposed without prior written consent.
11. No Legal or Medical Advice
Nothing in these Terms of Service or on our website constitutes legal, medical, or financial advice. Cannabis laws vary by jurisdiction. You are solely responsible for understanding and complying with all laws applicable to your use of our Service and purchase of cannabis products.
12. Privacy & Data Use
Your use of our Sites is governed by our Privacy Policy, which includes your rights under the NJDPA and the right to appeal denied privacy requests. Data collected through the Sweed platform is additionally governed by Sweed's Privacy Policy.
13. Right to Appeal Privacy Decisions
If Fire & Oak denies a privacy rights request you submit under the NJDPA, you have the right to appeal that decision. Submit your appeal to info@faomtholly.com with the subject line "Privacy Request Appeal." We will respond within 45 days with a written explanation. If your appeal is denied, you may file a complaint with the New Jersey Division of Consumer Affairs.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FIRE & OAK'S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF OUR SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO FIRE & OAK IN THE THREE (3) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED DOLLARS ($100).
IN NO EVENT SHALL FIRE & OAK BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Nothing in this section limits liability for fraud, gross negligence, willful misconduct, or any liability that cannot be excluded under applicable New Jersey law.
15. Governing Law & Dispute Resolution
Governing Law
These Terms and your use of Fire & Oak's main website, in-store operations, and loyalty program are governed by the laws of the State of New Jersey, excluding its conflicts of law rules. Note: The Sweed e-commerce platform is separately governed by California law per Sweed's Terms of Service.
Binding Arbitration
IMPORTANT: BY AGREEING TO THESE TERMS, YOU WAIVE YOUR RIGHT TO BRING CLAIMS IN COURT, TO HAVE A TRIAL BY JURY, AND TO PARTICIPATE IN ANY CLASS ACTION OR CLASS-WIDE ARBITRATION. Any dispute related to these Terms will be resolved through binding individual arbitration.
Arbitration will be conducted before a neutral arbitrator under the AAA Commercial Arbitration Rules, Consumer Due Process Protocol. The arbitrator may award the same damages and relief as a court. Proceedings will be conducted by telephone, online, or written submission at the option of the party seeking relief. To initiate arbitration, send written notice to info@faomtholly.com describing the dispute and relief requested. Fire & Oak will pay all AAA and arbitrator fees unless the claim is found frivolous.
Limitation Period
Any claim must be initiated within one (1) year after the cause of action arose. Claims not brought within this period are permanently barred.
Small Claims Exception
You may assert qualifying claims in small claims court rather than arbitration.
16. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions will continue in full force and effect.
17. Modifications & Termination
We may update these Terms at any time. Continued use of our Sites implies acceptance of updated Terms. Fire & Oak reserves the right to suspend or terminate access for violations.
